TN Visa status as a Lawyer

Lawyers are one of the several professions that can qualify for TN Visa status under the USMCA (NAFTA). If you are a Canadian or Mexican Lawyer with an offer of employment to work in the United States, you may qualify for TN Visa status. What is a lawyer for TN Visa purposes?

According to the US Bureau of Labor Statistics Occupational Outlook Handbook (OOH), the profession of a lawyer is defined as follows for immigration purposes:

Lawyers advise and represent individuals, businesses, and government agencies on legal issues and disputes. Lawyers typically do the following:

  • Advise and represent clients in courts, before government agencies, and in private legal matters
  • Communicate with their clients, colleagues, judges, and others involved in the case
  • Conduct research and analysis of legal problems
  • Interpret laws, rulings, and regulations for individuals and businesses
  • Present facts in writing and verbally to their clients or others, and argue on behalf of their clients
  • Prepare and file legal documents, such as lawsuits, appeals, wills, contracts, and deeds

Lawyers, also called attorneys, act as both advocates and advisors.

How do I qualify for TN Visa status as a lawyer?

You might qualify for TN Visa status as a lawyer if you meet the following minimum qualifications:

  1. You are a Canadian or Mexican Citizen (Permanent Residents do NOT qualify);
  2. You have a job offer from a US employer or are servicing a contract with a US client;
  3. You will be performing duties consistent with a lawyer under the OOH;
  4. You have an LL.B., J.D., L.L.L., B.C.L., or Licenciatura Degree (five years); OR membership in a state/provincial bar; and
  5. You can demonstrate that you have non-immigrant intent, in other words, the intent to return to your foreign residence at the end of your temporary employment.

Do I need a license to qualify for TN Visa status as a lawyer?

To practice law in any state, a person must be admitted to the state’s bar under rules established by the jurisdiction’s highest court. The requirements vary by state and jurisdiction. Although you can qualify for TN Visa status as a lawyer with either a degree OR licensure, licensure is a post-entry requirement and not required to obtain TN Visa status.
