US Immigration Update

On September 15, 2022, US Citizenship and Immigration Services (USCIS) announced the next phase in the Form I-907 Premium Processing expansion for qualifying EB-1 and EB-2 petitioners with pending I-140 Petitions. Beginning September 15, 2022, USCIS will now accept Form I-907 Premium Processing requests for the following categories:

  • E13 Multinational executive and manager petitions received on or before January 1, 2022, and
  • E21 NIW Petitions received on or before February 1, 2022.

USCIS will have 45 days to take action on requests for premium processing for these Form I-140 classifications.

What if my filing date is not listed in this expansion?

USCIS will REJECT any premium processing requests for these Form I-140 classifications if the receipt date is after these dates. USCIS will NOT accept initial Forms I-140 with a premium processing request at this time.

What version of USCIS Form I-907 should be used?

USCIS published a new version of Form I-907, dated 05/31/22. Only Form I-907 dated 05/31/2022 will be accepted. USCIS will no longer accept the older 09/30/20 edition of form I-907.

Both Canadian and Mexican citizens can qualify for TN visa status to work and live in the United States. In some cases, an employer decides to make the offer of employment permanent and sponsor the employee for US permanent residence (green card).
