Navigating the USCIS Form I-907 Premium Processing Expansion

In a significant development, USCIS announced an expansion of the Form I-907 Premium Processing service for qualifying EB-1 and EB-2 petitioners with pending I-140 Petitions. Effective September 15, 2022, USCIS will accept Form I-907 Premium Processing requests for the following categories:

  1. E13 Multinational Executive and Manager Petitions:
    • Petitions received on or before January 1, 2022.
  2. E21 NIW Petitions
    • Petitions received on or before February 1, 2022.

Key Points to Consider

  1. Processing Timeline:
    • USCIS commits to a 45-day processing timeline for premium processing requests within these Form I-140 classifications.
  2. Exclusion of Later Receipt Dates:
    • USCIS will reject premium processing requests for these categories if the receipt date is after the specified dates. Initial Forms I-140 with a premium processing request are not being accepted at this time.
  3. Mandatory Form I-907 Version:
    • USCIS mandates the use of the new version of Form I-907, dated 05/31/2022. The older 09/30/20 edition is no longer accepted.

What if Your Filing Date is Not Listed?

If your filing date falls outside the listed expansion dates, USCIS will not process premium processing requests for these specific Form I-140 classifications. It’s crucial to align your premium processing request with the outlined timelines and use the correct version of Form I-907.
