As it turns out, the party responsible for the “reasonable costs” of a return trip home for a prematurely-ended H-1B Visa holder depends on who called it quits on the employer/employee relationship.

  • If the employee is terminated before the end of the period of authorized stay, the employer will be liable for the reasonable costs of their return transportation.
  • If the employee voluntarily resigns the position, the employee is responsible for their own return transportation costs.

If you believe that your employer has not complied with this requirement, you must contact (in writing) the Service Center that approved your H-1B Visa petition.
