On December 20, 2023, the Department of State (DOS) revealed an eagerly awaited update: the initiation of the Stateside Visa Renewal Pilot from January 29, 2024, to April 1, 2024. This development comes after DOS shared an unpublished version of a Federal Register notice, scheduled to be officially published on December 21, 2023.
Eligibility Criteria for Participation
The pilot program is open to principal H-1B applicants seeking to renew their visas during the specified period. Notable eligibility criteria include having a prior H-1B visa issued by Mission Canada or Mission India within specific date ranges, an approved and unexpired H-1B petition, and a commitment to reenter the U.S. in H-1B status after a temporary period abroad.
Application Period and Process
Starting January 29, 2024, DOS will accept online applications through a dedicated website: https://travel.state.gov/content/travel/en/us-visas/employment/domestic-renewal.html. Application slots will be released weekly, with specific dates outlined, and the process will close when all slots are filled or on April 1, 2024, whichever occurs sooner.
Required Documents and Adjudication Process
Applicants must provide documents, including a completed DS-160 form, a recent photograph, a valid passport, Form I-797, and I-94 records. The application will be processed in the order received, with status updates available through the CEAC portal. DOS anticipates a processing time of 6-8 weeks and aims to complete all applications by May 1, 2024.
Visa Issuance and Potential Refusals
Once approved, visas, passports, and documents will be returned to applicants via USPS or a courier service. It’s crucial to note that visa issuance is not equivalent to a grant of nonimmigrant status, and no requests for expedited processing will be entertained. The blog post provides insights into potential refusals and the steps applicants can take in such scenarios.
