What is a lawyer for TN Visa purposes?

According to the US Bureau of Labor Statistics Occupational Outlook Handbook (OOH), the profession of a lawyer is defined as follows for immigration purposes:

Lawyers advise and represent individuals, businesses, and government agencies on legal issues and disputes. Lawyers typically do the following:

  • Advise and represent clients in courts, before government agencies, and in private legal matters
  • Communicate with their clients, colleagues, judges, and others involved in the case
  • Conduct research and analysis of legal problems
  • Interpret laws, rulings, and regulations for individuals and businesses
  • Present facts in writing and verbally to their clients or others, and argue on behalf of their clients
  • Prepare and file legal documents, such as lawsuits, appeals, wills, contracts, and deeds

Lawyers, also called attorneys, act as both advocates and advisors.

How do I qualify for TN Visa status as a lawyer?

You might qualify for TN Visa status as a lawyer if you meet the following minimum qualifications:

  1. You are a Canadian or Mexican Citizen (Permanent Residents do NOT qualify);
  2. You have a job offer from a US employer or are servicing a contract with a US client;
  3. You will be performing duties consistent with a lawyer under the OOH;
  4. You have an LLB, JD, LLL, BCL, or Licenciatura Degree (five years); OR membership in a state/provincial bar; and
  5. You can demonstrate that you have non-immigrant intent, that is, the intent to return to your foreign residence at the end of your temporary employment.

Do I need a license to qualify for TN Visa status as a lawyer?

To practice law in any state, a person must be admitted to the state’s bar under rules established by the jurisdiction’s highest court. The requirements vary by state and jurisdiction. However, licensure is a post-entry requirement and not required to obtain TN Visa status.
