On January 19, 2023, USCIS agreed to resume the bundling and adjudication of USCIS Form I-129 Petition for Alien Worker, USCIS Form I-539 Application to Extend/Change Status, and USCIS Form I-765 Application for Work Authorization for derivatives when filed concurrently.

In Edakunni, et al. v. Mayorkas, 1/19/2023, USCIS reached a settlement agreement in which they agreed to return to the past practice of adjudicating properly concurrent filings of Form I-129 Petitions for Alien Workers, Form I-539 Applications to Extend or Change Status, and Form I-765 Applications for Work Authorization for derivatives.

The impact of Edakunni, et al. v. Mayorkas is significant for dependants in H-4 and L-2 status. This will significantly speed up the adjudication of derivative applications and will keep families unified. The resumption of bundling these petitions and applications will happen whether or not premium processing is used through USCIS Form I-907.
