USCIS UPDATE – USCIS Extends COVID-19-related Flexibilities through Jan. 24, 2023

On October 24, 2022, US Citizenship and Immigration Services (USCIS) issued another extension to assist applicants, petitioners, and requestors respond to agency requests through Jan. 24, 2022. With this extension, USCIS has indicated that this will likely be the final extension of these flexibilities. Read more about this USCIS update here.

USCIS UPDATE – Military Naturalization Guidance for Calixto Class Members

On October 7, 2022, U.S. Citizenship and Immigration Services (USCIS) published updated guidance in the USCIS Policy Manual as a result of a settlement agreement in Calixto to v. Department of the Army, Civ. A. No. 18-1551 (PLF) (D.D.C.), known as the Calixto Agreement. Effective Sept. 22, 2022, the U.S. Army agreed to certify Form N-426, Request for Certification of Military or Naval Service, for Calixto class members.

USCIS Update – Extension of Temporary Waiver of 60-Day Rule for Civil Surgeon Signatures on Form I-693

On September 29, 2022, US Citizenship and Immigration Services announced an extension of the temporary waiver of the validity of the civil surgeon’s signature on USCIS Form I-693 Report of Medical Examination and Vaccination Record through March 31, 2023, for all Form I-693s that have not been adjudicated regardless of when the application was filed or signed by the civil surgeon.

On September 15, 2022, US Citizenship and Immigration Services (USCIS) announced the next phase in the Form I-907 Premium Processing expansion for qualifying EB-1 and EB-2 petitioners with pending I-140 Petitions.

US Immigration Update: Interviews no longer required for all Form I-751 Remove Condition Petitions

Effective immediately, USCIS will use a risk-based approach to determine which Form I-751, Petition to Remove Conditions on Residence will require an interview. This update replaces previous agency guidance that required all CPRs to undergo an interview if they obtained conditional resident status through consular processing. We discuss this update below.
