DOS: Interview Waivers for Temporary Employment

The US Secretary of State has empowered consular officers to waive the in-person interview requirement for specific temporary employment nonimmigrant visa applicants until the end of 2022. This guide aims to demystify the process and help you determine if you qualify for this interview waiver.

Who Qualifies for a Nonimmigrant Visa Interview Waiver?

Applicants for H-1, H-3, H-4, L, O, P, and Q visas may be eligible for an interview waiver if they meet the following conditions:

  1. Applying in Country of Nationality or Residence: The applicant must seek the visa in their country of nationality or residence.
  2. Previous Visa Issuance: They should have been issued a prior visa.
  3. No Visa Refusal History: No prior visa refusals unless successfully overcome or waived.
  4. Apparent Ineligibility: No apparent or potential ineligibility for the visa.

Additionally, first-time individual petition-based applicants from Visa Waiver Program (VWP) countries may qualify, provided they have no apparent ineligibility and have previously traveled to the U.S. with an ESTA authorization.

Interview Waiver for Visa Renewals

Applicants renewing any visa, including the TN Visa, within 48 months of expiration are eligible for an interview waiver, streamlining the process for those seeking to extend their temporary employment.

Understanding these conditions and exceptions ensures a smooth visa application journey. Stay informed and seize the opportunity for an interview waiver, which will make the process more efficient for eligible nonimmigrant workers.
