Why EADs Are Being Revoked
The Department of Homeland Security (DHS) has recently taken action to revoke some Employment Authorization Documents (EADs). These were issued to individuals paroled into the U.S. under humanitarian programs. DHS has the legal authority to revoke parole or EADs at any time.
Employees may still have an EAD that looks valid but is no longer authorized. Employers must act quickly and follow proper steps to stay compliant.
How E-Verify Alerts Have Changed
Previously, employers received E-Verify Case Alerts when an employee’s EAD was revoked. This is no longer the case.
Now: Employers must use the Status Change Report to check for revoked EADs.
How to Use the Status Change Report
- Log in to your E-Verify account.
- Click the Reports tab on the homepage.
- Select Status Change Report.
- Review for any revoked EADs.
If you work with an E-Verify Employer Agent, they can generate this report using the E-Verify browser.
Steps for Form I-9 Reverification
When the Status Change Report shows a revoked EAD (or an employee tells you directly), you must reverify their work authorization.
Use Form I-9 Supplement B
Download and complete Supplement B from I-9 Central.
Reverification Checklist:
- Request unexpired documents from List A or List C.
- Do not reverify identity documents (List B).
- Do not accept a revoked EAD, even if it looks valid.
- Do not create a new E-Verify case.
You must complete reverification within a reasonable time. If the employee cannot show new work authorization, employment must end.
Legal Reminders for Employers
The Immigration and Nationality Act (INA) prohibits discrimination based on national origin, citizenship, or immigration status during the Form I-9 or E-Verify process.
You may not:
- Ask for more or different documents than required.
- Require employees to present the same documents as before.
- Reject documents that reasonably appear genuine.
