1. Who Qualifies for the Automatic 540-Day EAD Extension?
The expanded automatic extension applies exclusively to EAD categories currently eligible for up to a 180-day extension. Eligible applicants with a timely-filed Form I-765 renewal application pending during the 18-month period after May 4, 2022, can now benefit from an automatic 540-day extension.
2. Duration of the Automatic 540-Day EAD Extension:
Commencing on May 4, 2022, the automatic 540-day EAD extension is set to expire on Oct. 27, 2023. After this date, the automatic extensions will revert to a 180-day period for applicants who timely file Form I-765 renewal applications.
3. Impact on Pending EAD Renewal Applications:
- Expired 180-Day Extension: Noncitizens with an expired 180-day automatic extension and pending EAD renewal applications will receive an additional period of employment authorization and EAD validity. This extension lasts up to 540 days from the EAD expiration date, allowing resumption of employment if within the automatic extension period and meeting eligibility criteria.
- Active 180-Day Extension: Those with an ongoing 180-day automatic extension will enjoy an additional up to 360-day extension, totaling up to 540 days beyond the current EAD expiration.
- Valid EAD on May 4, 2022: Noncitizens with a valid EAD on May 4, 2022, or those timely filing renewal applications before Oct. 27, 2023, secure an automatic extension of up to 540 days if their EAD expires before application processing.
