Suppose your employee has not already been issued an H1B visa in a previous lottery, and you are not an H1B Cap Exempt employer. In that case, you need to enter the H1B visa lottery for each employee you wish to employ under the H1B Visa status. After your employee is selected in the lottery, you can file an I-129 Petition for employment under H1B visa status on their behalf. We discuss the H1B Visa lottery and when to start the H1B visa process in 2023 for the upcoming FY 2024 H-1B Cap below.
When is the FY 2024 H1B Cap Registration Period?
Before an employee can be selected for an H1B visa in the lottery, the employer must register for the lottery. An employer must submit an H1B lottery registration for each employee they will enter into the H1B visa lottery. U.S. Citizenship and Immigration Services (USCIS) has not yet announced the initial registration period for the fiscal year 2024 H1B cap. However, since the implementation of the H1B Visa lottery, the registration period has begun on March 1st and runs for approximately 3 weeks. It is expected that the registration period for the fiscal year 2024 H1B Cap will mirror past registration periods.
How does the H1B Cap Registration work?
During the H1B Cap registration period, prospective employers are able to complete and submit registrations through the USCIS online H-1B registration system. Registration must be submitted for each potential employee. After successful registration, USCIS will assign a confirmation number for each registration submitted for the FY 2024 H-1B cap. The assigned number is ONLY used to track the registrations submitted. The assigned number simply confirms a successful registration it cannot be used to track the status of your case.
As an employer, how do we submit an H1B Cap Registration?
H1B Cap registrations are submitted using your myUSCIS account. Through your myUSCIS account, you will be able to submit an H1B lottery registration for each potential employee. You can only submit ONE registration per employee. Submitting multiple registrations for a single employee will VOID the submissions and does not increase your chances in the lottery. New registrations cannot be submitted until USCIS opens the registration window. In years past the window has opened at the end of February.
When should we begin the process for the FY 2024 H1B lottery registration?
The registration period is typically open for a 3-week time period. Registration is simple and can be done in a matter of minutes. We typically recommend beginning the process of collecting necessary supporting documents and USCIS registrations in mid-February. There is no advantage to entering the lottery on day 1. Whether you enter on the 1st or last day of the registration period you have the same odds of selection as all other registrants.
