New Alien Registration Requirement Effective April 11, 2025
A new interim final rule (IFR) published by the Department of Homeland Security (DHS) requires that, beginning April 11, 2025, certain foreign nationals staying in the U.S. for 30 days or more must register their presence by completing Form G-325R, Biographic Information (Registration). The rule amends 8 CFR Part 264 and designates Form G-325R as the standard registration document for individuals who have not yet been assigned an Alien Registration Number (A-Number). This measure enhances compliance with the Alien Registration Requirement under the Immigration and Nationality Act (INA).
Failure to comply with this requirement may result in penalties, including fines up to $5,000, imprisonment up to six months, or both.
Who Must Complete USCIS Form G-325R?
Mandatory Filing for Stays of 30 Days or More
Under the updated DHS regulation, the following individuals must file Form G-325R within 30 days of entry into the U.S.:
- Foreign nationals staying in the U.S. for 30 days or more who have not previously been assigned an Alien Registration Number (A-Number)
- Individuals applying for U.S. immigration benefits, including:
- Adjustment of Status (Form I-485)
- A Reentry Permit (Form I-131)
- Employment-based immigration benefits
- Certain visa applications requiring biographic verification
- Nonimmigrants who were not previously fingerprinted and registered through a visa application
- Aliens turning 14 years old while in the U.S. (must register within 30 days of their 14th birthday)
- Parents or legal guardians of minor children under 14 (required to register the child)
Who Is Exempt?
- Visa holders who were fingerprinted and registered as part of their application process
- A and G visa holders (diplomats and certain international organization representatives)
- Individuals who have already been issued an Alien Registration Number through another USCIS process
Information Required to Complete USCIS Form G-325R
If you are required to file Form G-325R, you will need to provide:
1. Personal Information
- Full legal name and any aliases
- Date and place of birth
- Gender
- Citizenship or nationality
- Alien Registration Number (if assigned previously)
2. Residence History
- Current U.S. address
- All addresses for the past five years, including dates of residence
3. Employment History
- Current employer’s name and address
- All employers from the past five years, including job titles and dates of employment
4. Marital and Family History
- Current marital status
- Spouse’s full name, date of birth, and place of birth
- Date and place of marriage
- Details of any prior marriages
5. Background Information
- History of arrests, detentions, or convictions
- Previous military service (if applicable)
- Past immigration history, including visa denials or removal proceedings
How to File USCIS Form G-325R
Starting April 11, 2025, individuals required to register must:
- Create an account on myUSCIS (https://my.uscis.gov)
- Complete and submit Form G-325R online
- Schedule and attend a Biometrics Services Appointment at a USCIS Application Support Center (ASC)
- Obtain proof of Alien Registration via their myUSCIS account
After completing the biometrics appointment, USCIS will issue a Proof of Alien Registration document, which must be carried at all times by individuals over 18.
Consequences of Noncompliance
Failure to file Form G-325R as required may result in:
- Criminal penalties, including fines up to $5,000 or imprisonment for up to six months
- Deportability under 8 U.S.C. 1227(a)(3)(B)(i) for fraudulent or willful failure to register
- Difficulties obtaining future immigration benefits, such as a Green Card or work authorization
